Terms and Conditions

Last updated: October 14, 2026

These Terms and Conditions ("Terms") govern your access to and use of CountyOffice.org (the "Website") and related services, including the purchase of property-related reports (collectively, the "Service"). By accessing or using the Service, you agree to these Terms.

1. Interpretation and Definitions

1.1 Interpretation

Capitalized words have meanings defined below.

1.2 Definitions

2. Acknowledgment; Eligibility; Privacy Policy

2.1 Acceptance

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2.2 Eligibility

You represent that you are at least 18 years old and have the legal capacity to enter into these Terms.

2.3 Privacy Policy

Your use of the Service is also subject to our Privacy Policy, which is incorporated by reference. Please review it carefully.

2.4 Electronic Communications

By using the Service or placing an Order, you consent to receive communications from us electronically (for example, by email or by notices posted on the Website). You agree that electronic communications satisfy any legal requirement that such communications be in writing.

2.5 Notices

You agree that we may provide notices to you by email or by posting to the Website. If you need to provide us notice under these Terms, you must do so by email to support@countyoffice.org and by mail to our address listed in Section 21, unless these Terms specify otherwise.

3. Service Overview; Data Sources; Nature of Information

3.1 General Description

The Service provides property-related information and tools, including the ability to purchase Reports containing additional details.

3.2 Data Sources; No Verification

Property information is derived from public records maintained by county and local government offices (recorders and clerks, assessors, tax collectors) and may include datasets published by federal agencies. We obtain county and local records through licensed data providers that collect and standardize them; federal datasets, where used, are collected directly from the publishing agency. Reports also draw on publicly available sources, which are listed in each Report. The Company does not independently verify every record or source. Information may be incomplete, inaccurate, or out of date.

3.3 Not Official Records; Not Professional Advice

The Service and Reports are provided for informational purposes only and are not official government records. They are not a substitute for a title search, land survey, appraisal, official flood zone determination, or professional legal, tax, or financial advice. You should verify information with official sources and qualified professionals before relying on it.

3.4 Changes to the Service

We may modify, suspend, or discontinue any part of the Service (including features, data sources, and availability) at any time.

4. Orders; Pricing; Payments; Delivery

4.1 Subscriptions and One-Time Purchases

We offer both (a) one-time purchases of individual Reports and (b) Subscriptions that provide ongoing access to subscription features. Included features, any included Reports, and pricing are shown at checkout.

4.2 Pricing and Taxes

Prices are shown at checkout and may change over time. Taxes may apply depending on your location and applicable law.

4.3 Payment Processing

Payments are processed by third-party payment processors (e.g., Stripe). By placing an Order, you authorize the payment processor to charge your selected payment method for the total amount shown at checkout.

4.4 Delivery

Reports are typically ready within 15–30 minutes, but times may vary. When your report is ready, we'll send an email notification with a link to download it from your account dashboard. You are responsible for providing an accurate email address. Delivery notifications may be affected by spam filters or email delivery issues; check spam/junk folders if you don't receive the email.

4.5 Refunds; Chargebacks

Because Reports are digital goods, all sales are final except where required by law. If we cannot generate or deliver a purchased Report after reasonable efforts, we will either refund the amount paid for that Report or provide a replacement Report.

Subscription fees (including renewal charges) are non-refundable except where required by law. Canceling stops future renewals, but your subscription remains active through the end of your current Billing Period.

If you initiate a chargeback or payment dispute without contacting us first to attempt resolution, we may suspend or terminate your access to the Service.

4.6 Order Acceptance; Errors

We reserve the right to refuse, cancel, or limit any Order (including due to suspected fraud or pricing/description errors). If we cancel an Order after payment, we will refund the amount paid for that Order.

5. Prohibited Uses; FCRA-Related Restrictions; Acceptable Use

5.1 Prohibited Eligibility Uses (FCRA-Related)

You may not use the Service or any Report for tenant screening, employment screening, credit eligibility, insurance eligibility, or any other eligibility decision about an individual that is subject to the Fair Credit Reporting Act ("FCRA") or similar laws. Do not use the Service as a "consumer report" for such purposes.

5.2 Additional Prohibited Uses

You agree not to:

  1. use the Service to harass, stalk, threaten, defame, or violate the privacy or other rights of any person;
  2. use the Service to contact individuals in ways that violate applicable laws or expressed preferences;
  3. use any Content to build, train, or enhance a competing database, product, or service;
  4. copy, reproduce, publish, sell, license, rent, lease, or redistribute Content or Reports except as expressly permitted in Section 8;
  5. use automated means (bots, scrapers, crawlers) to access, extract, or index the Service or Content without our express written permission; this does not restrict search engines, AI assistants, and similar services that access the Service in accordance with our robots.txt file;
  6. bypass or attempt to bypass access controls, rate limits, or security measures.

5.3 Compliance With Law

You are responsible for your use of the Service and must comply with all applicable laws and regulations.

6. Fair Use; Rate Limiting; Anti-Abuse

To protect the reliability of the Service, we may impose usage limits, throttling, or other restrictions (including limiting searches or queries). We may monitor usage patterns to detect abuse, automation, or suspicious activity. If we believe activity violates these Terms, we may suspend or restrict access.

7. Accounts

7.1 Account Responsibility

If you create an Account, you must provide accurate and current information and keep your credentials secure. You are responsible for all activity under your Account.

7.2 Suspension/Termination

We may suspend or terminate Accounts for violations of these Terms or to protect the Service, other users, or third parties.

8. Intellectual Property; License; Use of Reports

8.1 Ownership

The Service and Content are owned by the Company and/or its licensors and are protected by intellectual property laws.

8.2 Limited License to Use the Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business purposes.

8.3 License to Use Reports

Upon purchase, you receive a limited, non-exclusive, non-transferable license to use the purchased Report for your personal or internal business purposes. You may share a purchased Report internally within your organization (e.g., employees/contractors) solely for your internal use.

You may not resell, redistribute, publicly post, publish, or otherwise commercially exploit Reports or underlying data unless we expressly agree in writing.

9. Links to Third-Party Websites

The Service may contain links to third-party websites. We do not control and are not responsible for third-party content, policies, or practices. Access third-party sites at your own risk.

10. Disclaimers

10.1 "AS IS" and "AS AVAILABLE"

The Service and Content are provided "AS IS" and "AS AVAILABLE," without warranties of any kind, to the maximum extent permitted by law.

10.2 No Warranty of Accuracy or Availability

We do not warrant that the Service will be uninterrupted or error-free, or that Content (including property data) is accurate, complete, current, or reliable.

10.3 Not an Appraisal; Not a Title Search; Not Tax Advice

Any value estimates or ranges are informational only and are not an appraisal. The Service is not a title commitment/policy and is not a substitute for a full title search or title insurance. Tax/assessment information is informational only and not tax advice; appeal rules and outcomes vary by jurisdiction. Flood zone, wildfire, coastal barrier, and historic designation information is derived from federal datasets at the parcel location, is informational only, and is not an official flood zone determination, insurance rating, or hazard assessment.

11. Limitation of Liability

To the maximum extent permitted by law, the Company and its Service Providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or business interruption.

To the maximum extent permitted by law, our total liability for any claim relating to the Service or any Report will not exceed the amounts you paid to us in the twelve (12) months before the claim arose or $100, whichever is less.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, contractors, and Service Providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  1. your use of the Service or Reports;
  2. your violation of these Terms;
  3. your violation of any law or third-party rights; or
  4. your misuse of Content (including any prohibited eligibility decision uses).

13. Termination

We may terminate or suspend your access to the Service immediately for any reason, including violation of these Terms. Sections that by their nature should survive termination (including Sections 8-12 and 14) will survive.

14. Governing Law; Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of the State of New York, excluding conflict-of-law rules.

14.2 Arbitration Agreement; Class Action Waiver; Jury Trial Waiver (AAA)

  1. Informal Resolution First. If you have any dispute, claim, or controversy arising out of or relating to the Service, any Report, or these Terms ("Dispute"), you agree to first attempt to resolve it informally by providing notice to us. You must send a written notice describing the Dispute and the relief you seek to: support@countyoffice.org and/or Growlogics LLC, 21 Artisan Ave, Huntington, NY 11743. We will attempt to resolve the Dispute in good faith. If the Dispute is not resolved within thirty (30) days after we receive your notice, either party may proceed as set forth below.
  2. Agreement to Arbitrate. Except as expressly permitted in subsection (c) (Small Claims and Injunctive Relief), you and the Company agree that any Dispute will be resolved by final and binding, individual arbitration administered by the American Arbitration Association ("AAA"), and not in court. This agreement to arbitrate is governed by the U.S. Federal Arbitration Act (FAA).
  3. Exceptions. Either party may:
    1. bring an individual action in small claims court if the claim qualifies and remains in that court; and
    2. seek injunctive or equitable relief in a court of competent jurisdiction to stop unauthorized use, scraping, access circumvention, or infringement/misappropriation of intellectual property or other proprietary rights.
    If a small claims action is transferred, removed, or appealed to a court of general jurisdiction, it will be subject to arbitration.
  4. AAA Rules. The arbitration will be administered by AAA under its Consumer Arbitration Rules then in effect, unless AAA determines that the Commercial Arbitration Rules apply. AAA rules and information are available at https://www.adr.org/consumer.
  5. Arbitration Procedure; Location. The arbitration will be conducted by a single neutral arbitrator. The arbitrator may award the same damages and relief that a court could award (including attorneys’ fees and costs where available under applicable law). Unless you and the Company agree otherwise, the arbitration will be conducted by videoconference or telephone, or in the county (or parish) where you reside, consistent with the AAA rules.
  6. Fees and Costs. Payment of filing, administration, and arbitrator fees will be governed by the AAA rules and applicable law. The arbitrator may award fees and costs to the extent permitted by applicable law and the AAA rules.
  7. Class Action Waiver. YOU AND THE COMPANY AGREE THAT DISPUTES MUST BE BROUGHT IN EACH PARTY’S INDIVIDUAL CAPACITY ONLY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of class, collective, or representative proceeding.
  8. Jury Trial Waiver. IF FOR ANY REASON A DISPUTE PROCEEDS IN COURT RATHER THAN IN ARBITRATION, YOU AND THE COMPANY EACH WAIVE ANY RIGHT TO A JURY TRIAL TO THE MAXIMUM EXTENT PERMITTED BY LAW.
  9. Opt-Out Right. You may opt out of this arbitration agreement within thirty (30) days of the date you first accept these Terms by sending an email to support@countyoffice.org with the subject line "Arbitration Opt-Out" and including your name and the email address associated with your use of the Service, along with a clear statement that you are opting out. If you opt out, neither you nor the Company will be bound by this arbitration agreement.
  10. Severability. If any portion of this Section 14.2 is found to be unenforceable, the unenforceable portion will be severed and the remainder will be enforced to the fullest extent permitted by law. If subsection (g) (Class Action Waiver) is found unenforceable with respect to a particular claim, then that claim will proceed in court (and not in arbitration), while the remaining claims will proceed in arbitration.
  11. Mass Filings ("Mass Arbitration")
    1. Definition; AAA Administration. If twenty-five (25) or more similar demands for arbitration are filed against the Company (or its related entities) by or with the assistance of the same or coordinated counsel or representatives, and the AAA determines that the applicable fee schedule and AAA mass arbitration criteria are met, the parties agree that the set of demands may be administered as a mass arbitration under the AAA’s Mass Arbitration Supplementary Rules and the applicable AAA mass arbitration fee schedule then in effect. In the event of any conflict between this Section 14.2 and the AAA’s Mass Arbitration Supplementary Rules, the AAA’s Mass Arbitration Supplementary Rules will control with respect to the administration of the mass arbitration.
    2. Required Filing Materials. The parties and their representatives will comply with all AAA requirements applicable to mass arbitration filings, including providing any required case-filing spreadsheet, affirmations/attestations, and other information reasonably requested by the AAA for administration.
    3. Staged Merits Proceedings (Batching). To promote the fair and efficient resolution of a mass arbitration, and to the extent permitted by applicable law and the AAA’s rules, merits arbitrations will proceed in stages:
      1. Initial Batch. After the AAA confirms administration as a mass arbitration (or as otherwise directed by a Process Arbitrator), an initial batch of ten (10) cases will proceed to merits arbitration. The claimants (through their counsel) will select five (5) cases and the Company will select five (5) cases. If fewer than five (5) cases remain available for selection by either side, the remaining cases for that side’s selection will be chosen at random from the remaining pool.
      2. Stay of Remaining Cases. All other cases will be temporarily stayed (including merits arbitrator appointment and merits proceedings) while the Initial Batch proceeds, unless the parties agree otherwise or the Process Arbitrator directs otherwise.
      3. Mediation / Settlement Discussions. Following final awards (or other final resolution) in the Initial Batch, the parties will participate in good-faith settlement discussions, including any global mediation process made available by the AAA, for at least thirty (30) days (unless the parties mutually agree that further mediation would be futile).
      4. Additional Batches. If the remaining cases are not resolved after the Initial Batch and settlement discussions, additional batches of ten (10) cases will proceed on the same selection basis described above (or on another basis ordered by the Process Arbitrator), until all cases are resolved.
    4. Tolling. For any case that is stayed under this subsection, any applicable limitations period will be tolled from the date the demand for arbitration was submitted to the AAA until the date that case is selected for a merits arbitrator appointment (or otherwise directed to proceed).
    5. Process Arbitrator Authority. Any disputes about the application, interpretation, or implementation of this subsection (including batch size, selection process, scheduling, locale, and conditions precedent) will be decided in the first instance by the AAA-appointed Process Arbitrator (if any) or as otherwise provided under the AAA’s Mass Arbitration Supplementary Rules.
    6. No Class or Representative Proceedings. Nothing in this subsection authorizes class, collective, private attorney general, or representative arbitration. Each case remains an individual arbitration subject to Section 14.2(g) (Class Action Waiver).

15. U.S. Legal Compliance (Export Controls)

You represent that you are not located in a country subject to U.S. embargo and are not on any U.S. restricted-party list.

16. Severability; Waiver

If any provision is found unenforceable, the remaining provisions remain in effect. Failure to enforce any right is not a waiver.

17. Assignment

We may assign these Terms (including all rights and obligations) in connection with a merger, acquisition, sale of assets, or by operation of law. You may not assign these Terms without our prior written consent.

18. Entire Agreement

These Terms and any policies referenced herein (including the Privacy Policy) constitute the entire agreement between you and the Company regarding the Service and supersede any prior agreements or understandings.

19. No Third-Party Beneficiaries

Except as expressly stated, these Terms do not confer any third-party beneficiary rights.

20. Changes to These Terms

We may update these Terms from time to time. Changes are effective when posted. By continuing to use the Service after changes take effect, you agree to the updated Terms.
